This page describes the terms of use that apply to all internet users visiting this Site (as defined below). These terms of use do not apply to third-party websites to which this Site may link. This Site is managed and operated by Atlantis Health (Australia) Level 5, 7 Eden Park Drive, Macquarie Park, NSW, 2113, Australia (“Atlantis”) for and on behalf of the sponsor of Taltz^®, Eli Lilly Australia Pty Limited, Level 9, 60 Margaret Street, Sydney NSW 2000 Australia (“Lilly”), hereinafter referred to together as “the Parties”. The layout and each of the components, including trademarks, logos and domain names, appearing on this Site www.touchpoint-support.com.au (hereinafter the “Site”), are protected by current laws on intellectual property, and belong to Lilly or its subsidiaries, or their use is the subject of an authorisation.
   2. No component of this Site may be copied, reproduced, altered, edited, downloaded, denatured, transmitted or distributed in any way whatsoever, on any medium whatsoever, in whole or in part, without the prior written consent of the Parties or as described below.
   3. You may freely browse this Site and download materials for your own personal, non-commercial use. You may not, however, distribute, modify, transmit, reuse, repost or use any of such materials for public or commercial purposes, without the express written permission of the Parties. All copyright and other proprietary notices contained in downloaded materials must be retained.
   4. Unless otherwise stated, all copyright and other intellectual property rights subsisting in this Site and the material on this Site (including without limitation, the text and graphics comprised in this Site) are owned or licensed by Lilly and protected by the laws of New South Wales, Australia.

   7. Lilly or its subsidiaries reserve the right to take legal action against any breach of its intellectual property rights.

5. Availability of this Site

6. Your use
   1. By using this Site, you agree:
      1. not to disrupt or intercept our electronic information posted on this Site or on any of our servers in any way;
      2. not to tamper with, hinder the operation of or make unauthorised modifications to this Site including the storage or transmission of any virus or disabling feature to this Site.

7. Indemnity
   1. You indemnify the Parties and hold the Parties indemnified from any claim, demand or expense made by or on behalf of any third party for damages or an account of profit or any equitable relief including but not limited to, consequential, direct, incidental or other damages (including legal fees on a solicitor-own client basis) for any breach by you of any law or the rights of a third party including, but not limited to any breach occurring in relation to an activity arranged or conducted pursuant to the direct or indirect use of this Site.
8. Termination
   1. Atlantis may terminate or limit your access to this Site in the Parties absolute discretion without notice or liability to you for any reason including:
      1. if you breach any part of these terms and conditions;
      2. if the parties are required to do so by applicable law;
      3. if you use this Site for any activities which breach any laws, regulations, standards or codes or infringe a third party’s rights or privacy;
      4. if you tamper with, hinder the operation of or make unauthorised modifications to this Site including the storage or transmission of any virus or disabling feature to this Site; or
      5. if you attempt to do any of the above acts or permit or assist another person to do any of the above acts.
   2. The limitations of liability and disclaimers made by us in these terms and conditions will survive termination of your access to this Site. If any of these terms and conditions are invalid or unenforceable, the relevant term will be struck out and the remaining terms will remain in force. If Atlantis does not act in relation to a breach by you of these terms and conditions, this does not waive Atlantis’ right to act with respect to subsequent or similar breaches.
9. Legal provisions
   1. This Site and its content are governed by the Laws of New South Wales, Australia. Users of this Site submit to the non-exclusive jurisdiction of the courts of New South Wales. If a court finds that any provision of these terms and conditions are invalid or unenforceable, you agree that the other provisions of these terms and conditions will remain in full force and effect.
   2. This Site is intended for the exclusive use of residents of Australia over 18 years of age who have been prescribed Taltz. Atlantis make no representation that the material on this Site is appropriate for use in other locations. If you access this Site from outside Australia, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. This Site is not intended for or designed to attract individuals who are under 18 years of age.
10. Status
    1. Atlantis reserves the right to amend these terms and conditions and by using this Site you acknowledge that you have read, understand, and agree to be bound to the then current terms and conditions. If you do not accept the terms and conditions or any changes to the terms and conditions, you must not use or continue to use this Site.
